1. PURPOSE
These general terms and conditions of sale are intended to define the rights and obligations of JEAN LOUIS FOURES and the Customer regarding products presented by JEAN LOUIS FOURES on its website www.ateliersfoures.fr (hereinafter "the Site"). They apply exclusively between the company JEAN LOUIS FOURES, 27 avenue Gay Lussac 81300 Graulhet, Siret: 340 234 079 00036 (hereinafter "JEAN LOUIS FOURES") and any natural person visiting or making a purchase via said Site (hereinafter "the Customer").
On the Site, JEAN LOUIS FOURES allows the Customer to order products from the JEAN LOUIS FOURES brand online (hereinafter "the Product(s)") under these general terms and conditions.
Any order placed with JEAN LOUIS FOURES therefore implies the Customer's unreserved acceptance of these conditions. These general terms and conditions may be modified at any time without notice by JEAN LOUIS FOURES, the applicable conditions being those in force on the date of the order by the Customer.
These general terms and conditions of sale are permanently accessible on the website www.ateliersfoures.fr in an electronic format allowing for their printing and/or downloading, so that the Customer can reproduce or save them.
2. PRODUCTS AND COMPLIANCE
2.1. The Products offered for sale are presented on the website www.ateliersfoures.fr. They are offered to the user within the limits of available stocks and may be subject to pre-order. Each product is described in detail, mentioning its essential characteristics, allowing any user to choose a product suited to their needs.
2.2. The Products offered by JEAN LOUIS FOURES comply with the standards applicable in France.
Elements such as photographs, texts, graphics, as well as all information and characteristics illustrating and/or accompanying the Products, are not contractual, which the Customer acknowledges.
Consequently, JEAN LOUIS FOURES cannot be held liable in the event of an error or omission in any of these elements or in the event of modification of said elements by suppliers and/or publishers.
3. CUSTOMER OBLIGATIONS
3.1. The Customer declares that they are at least 18 years old and have the legal capacity or hold parental authorization allowing them to place an order on the Site.
3.2. The Customer undertakes to provide JEAN LOUIS FOURES with true information necessary for the provision of the service that is the subject of these terms, as requested online and according to their situation, including their surname, first name, address, telephone number, and a valid email address.
The Customer is responsible for the consequences resulting from false or inaccurate information provided or whose use would be illicit.
3.3. Once the order is placed, JEAN LOUIS FOURES sends the Customer an email confirming it. It then informs the Customer of the dispatch of the Products.
3.4. The Customer can modify their data in the "my account" section. The customer understands that they can only modify their data for future orders. Any order in progress at the time of the modification of data in the "my account" section will not be modified.
4. ORDER AND PRE-ORDER
4.1. Any order or pre-order will only be validated after receipt of payment.
4.2. JEAN LOUIS FOURES reserves the right to cancel or refuse an order or pre-order in the event of a dispute with the Customer regarding a previous order.
4.3. JEAN LOUIS FOURES accepts orders within the limits of available stocks. It informs the Customer of the availability of the Products sold on the Site at the time of order confirmation.
4.4. Out-of-stock products can be pre-ordered. The pre-order is subject to the same general terms and conditions of sale as orders.
If, despite the vigilance of JEAN LOUIS FOURES, the products are unavailable, JEAN LOUIS FOURES will inform the Customer by email as soon as possible. The Customer may then either cancel their order and be reimbursed for the sums already paid, or keep their order for delivery as soon as the products are back in stock.
Definitive or temporary unavailability cannot under any circumstances engage the liability of JEAN LOUIS FOURES, nor can it open any right to compensation or damages in favor of the Customer.
5. PRICE
5.1. The prices displayed on the Site are indicated in euros, including all French taxes (French VAT and other potentially applicable taxes), excluding shipping costs, contribution to order processing costs, and packaging costs.
Shipping costs, contribution to order processing costs, and packaging costs will be indicated in the Customer's shopping cart, before final validation of the order.
Prices may be modified at any time, without notice, and particularly in the event of changes in tax or economic data. Items will be invoiced on the basis of the rates in force at the time the order is registered.
6. DELIVERY
6.1. JEAN LOUIS FOURES delivers its Products in metropolitan France and overseas, in Europe, and outside the EU.
The products are shipped to the delivery address indicated by the Customer during their order, within the timeframes announced by the Site at the time of order validation.
Delivery cannot be made to hotels or P.O. boxes.
JEAN LOUIS FOURES undertakes to deliver orders within the time indicated when choosing the carrier. The timeframes indicated correspond to average processing and delivery times. In order for these times to be respected, the Customer must ensure that they have provided accurate and complete information regarding the delivery address (such as, in particular: street number, building number, staircase, access codes, names and/or intercom numbers, etc.).
The Customer acknowledges that, in the event of a pre-order, the delivery time will be extended. The estimated delivery time appears on the product sheet at the time of purchase, and in the order confirmation email. The delivery time depends on the time required and the production volume of all pre-ordered products and may vary.
JEAN LOUIS FOURES undertakes to inform the Customer of the progress of their order processing.
Upon receipt of the Products, the Customer is required to check the condition of the merchandise packaging and to report any damage to the carrier on the delivery note, as well as to JEAN LOUIS FOURES, within two (2) days by sending a message via the contact form on our site.
JEAN LOUIS FOURES cannot be held responsible for consequences due to a delay in delivery not of its own making.
7. PAYMENT
Full payment must be made when ordering. At no time can the sums paid be considered as deposits or down payments. The Customer pays for their order by credit card (Visa, Eurocard/Mastercard), with their Paypal account, or by payment in several installments without fees, in accordance with the provisions of this article.
JEAN LOUIS FOURES does not accept payment by check or bank transfer. The customer must use the other payment methods offered.
For any transaction, the Customer will indicate the number appearing on the front of their card, the expiration date of their card, and the cryptogram appearing on the back of their card (last three digits).
The communication of their credit card number by the Customer constitutes authorization for JEAN LOUIS FOURES to debit their account to the amount of their order.
No shipment on delivery will be accepted, for any reason whatsoever.
JEAN LOUIS FOURES retains ownership of the item until full payment of the price by the Customer. Purchases are made securely. The payment solutions adopted by JEAN LOUIS FOURES are 100% secure. For payments by credit card (Carte Bleue, Carte Bleue Visa, and e-Carte Bleue), all information that Customers communicate to JEAN LOUIS FOURES is strictly protected and guarantees the compliance and security of each transaction.
A credit is binding and must be repaid. Check your repayment capacity before committing. If you pay for your order in several installments, you accept the Klarna general terms and conditions of sale.
8. PRODUCT RETURN AND REFUND
RIGHT OF WITHDRAWAL
Within fourteen (14) days of receipt of their order, the Customer may request from JEAN LOUIS FOURES the return of the Product(s).
No returns, refunds, or credits can be made at a multi-brand retailer selling JEAN LOUIS FOURES products.
Returns are free from Metropolitan France (including Corsica and Monaco). Returns are paid for Europe and countries outside the EU.
To take advantage of free returns, please contact customer service via the contact form. Customer service will provide you with a return slip and indicate the procedure to follow.
Once the label is received, the package must be dropped off within fourteen (14) days at a relay point. Beyond this period, returns will no longer be accepted.
When refunding, JEAN LOUIS FOURES will proceed with a full refund of the order, provided that the Product is returned in its original packaging, in its original condition, new, unworn, and unwashed.
The return is at the Customer's risk. The Product must be returned in its original packaging, in its original condition, new, unworn, and unwashed.
In the absence of compliance by the Customer with these conditions, in particular the return conditions, JEAN LOUIS FOURES will not be able to proceed with the refund or the issuance of a credit note for the products concerned. The Product will then be returned to the Customer.
9. WARRANTIES AND LIABILITY
9.1. JEAN LOUIS FOURES has only an obligation of means for all stages of access to the site, from the ordering process to the shipment of the package or subsequent services.
The liability of JEAN LOUIS FOURES cannot be engaged for any inconveniences or damages inherent to the use of the internet network, in particular a service interruption, an external intrusion, or the presence of computer viruses, or any fact qualified as force majeure, in accordance with law and jurisprudence.
JEAN LOUIS FOURES undertakes to use the confidential information of Customers only in the context of the operation of its Site.
For the proper conduct of the order, the personal data collected will be subject to computer processing, which the Customer acknowledges.
In this capacity, information concerning them may be communicated to JEAN LOUIS FOURES' technical service providers.
Furthermore, JEAN LOUIS FOURES may apply technical means to obtain non-personal information relating to internet users intended to improve the site's functionality, for example by tracking the number of visitors to certain pages.
In accordance with the law of January 6, 1978, as amended by the law of August 6, 2004, the Customer has the right to access and rectify personal data concerning them appearing in the files of JEAN LOUIS FOURES. 9.2. In accordance with the provisions of the legal warranties of conformity and hidden defects, we refund or exchange products that are apparently defective or do not correspond to the Customer's order. The Customer must report the non-compliance of their Product to JEAN LOUIS FOURES within two (2) days by sending a message via the contact form on our site.
The products must be returned to us in the condition in which the customer received them with all elements in packaging allowing transport in good conditions. Shipping costs will be refunded on the basis of the invoiced rate and return costs will be covered by JEAN LOUIS FOURES via a prepaid return label.
To be able to benefit from the product warranty, the customer is asked to keep the purchase invoice and the original packaging. Any warranty is excluded in case of misuse, poor storage, or negligence by the customer, as well as in case of normal wear and tear, accident, or force majeure or similar according to French jurisprudence.
9.3. JEAN LOUIS FOURES offers its Customers lifetime after-sales service at cost price. Any Product purchased on the Site is eligible for this service.
To benefit from it, the Customer must contact JEAN LOUIS FOURES by sending a message via the contact form on our site. JEAN LOUIS FOURES, after having obtained the necessary information, will establish a quote including only the cost price of the materials allowing the repair. The Customer is free to accept or refuse this quote.
Payment for this service will be made by Credit Card (Visa, Mastercard) only.
10. INTELLECTUAL PROPERTY
Under no circumstances is the Customer authorized to download or modify all or part of the Site, in particular its content (listed products, descriptions, images, videos, etc.).
This Site or any part of this Site must not under any circumstances be reproduced, copied, sold, or exploited for commercial reasons without the express written authorization of JEAN LOUIS FOURES.
Generally speaking, all copyrights, trademarks, and other distinctive signs and property or intellectual property rights appearing on the Site will remain the full and entire property of JEAN LOUIS FOURES.
The Customer is therefore required to respect intellectual property rights and may in no way use the trademarks appearing on the Site and on the Products if applicable, or register a trademark that would prejudice the rights holder, unless otherwise contractually stipulated.
The same applies to any other intellectual property right.
12. FORCE MAJEURE
In the event of the occurrence of an event of force majeure, the party concerned must inform the other within fifteen (15) days of the occurrence of this event, by registered letter with acknowledgment of receipt.
Expressly, are considered cases of force majeure or fortuitous events, in addition to those usually accepted by the jurisprudence of French courts and tribunals, total or partial strikes, lock-outs, riots, boycotts or other industrial actions or commercial disputes, civil unrest, insurrection, war, bad weather, epidemics, blockage of means of transport or supply for any reason whatsoever, earthquakes, fires, storms, floods, water damage, government or legal restrictions, legal or regulatory changes in forms of marketing, computer breakdown, blocking of telecommunications, including wired or wireless telecommunications networks, and any other case independent of the will of the parties preventing the normal execution of the contractual relationship.
All obligations of the parties will be suspended for the duration of the force majeure event, without compensation.
If the force majeure event continues for more than three (3) months, the contract concerned may be terminated automatically without compensation for either party.
13. GENERAL PROVISIONS
13.1. PARTIAL INVALIDITY OF A CLAUSE
If any of the stipulations of these terms is declared null or unenforceable by a competent jurisdiction, it will be declared unwritten and will not result in the nullity of the other stipulations.
13.2. UPDATING
These general terms and conditions may be modified at any time without notice by JEAN LOUIS FOURES, with the applicable terms being those in force on the date of the order by the Customer.

13.3. APPLICABLE LAW – COMPETENT COURT
We hope it won't happen, but disagreements can arise!
